STEVENS POINT, WI (WSAU) — A man suspected of child abuse will go to trial in mid-October.
David Schmies’ week-long trial has once again been rescheduled, this time delayed from late August to October 12th through the 16th. He faces a high-level felony count for repeated abuse of the same child stemming from a 2022 complaint.
Investigators say the 26-year-old caused serious injuries to a three-month-old child, including broken bones and bleeding on the brain, all of which were consistent with abuse. Schmies told doctors that the child had fallen off a bed, but they noted that a fall from that height would not have caused the injuries presented.
Additionally, doctors noted that some of the broken bones were in “various stages of healing,” indicating that abuse may have taken place over time.
Charges were filed in December 2022. The case has been scheduled for trial on numerous occasions only to be canceled or delayed for various reasons. In one instance, the trial was delayed because his defense team couldn’t find an expert witness. Other cases weren’t explained in court records.
The most recent delay was granted at the state’s request.
A final pretrial conference is scheduled for September 28th. The five-day trial begins October 12th.
Schmies faces up to 40 years in prison and 20 years on extended supervision if found guilty at trial.
